These Terms of Service ("Terms") govern your access to and use of smartpersonfinancial.com and the credit education, dispute preparation, and capital advisory services offered by SmartPerson Financial ("we," "us," or "our"). By accessing our website, submitting an application, or enrolling in a program, you agree to be bound by these Terms. If you do not agree, do not use the Services.
SmartPerson Financial offers two primary programs: Standard Access (ClearPath®), which focuses on credit report review, dispute resolution, and debt paydown strategy; and Full Access (CapitalPath® 360), which builds on Standard Access with banking relationship building and access to funding opportunities. Specific services, timelines, and pricing are described at enrollment and may vary by client based on individual circumstances.
You must be at least 18 years old and capable of entering a binding contract to use the Services. By applying, you represent that the information you provide is accurate and that you are applying on your own behalf.
Enrollment in a program requires acceptance of a separate services agreement and payment of applicable fees, which are disclosed to you before you are charged. Fees are processed by a third-party payment provider. Any refund, cancellation, or billing dispute policy is governed by the services agreement you sign at enrollment, not by this website.
SmartPerson Financial does not guarantee any specific outcome, including but not limited to a particular credit score increase, removal of any specific item from a credit report, approval for any loan, credit line, or funding amount, or any specific timeline for results. Credit bureaus and creditors are not required to remove accurate information, and outcomes depend on facts specific to your credit file that are outside our control. Under federal law (including the Credit Repair Organizations Act), no credit repair organization may guarantee results before services are performed, and you have the right to cancel certain agreements within three business days as described in your services agreement.

You agree not to misuse the Services, including by submitting false information, attempting to access another user's account, interfering with the operation of the website, or using the Services for any unlawful purpose.
Our website may reference or link to third-party offers, including partner credit monitoring services. We are not responsible for the content, accuracy, or practices of third-party sites, and any transaction you enter with a third party is solely between you and that party.

The Services and this website are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, SmartPerson Financial and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services, even if advised of the possibility of such damages.
Nothing on this website or provided through the Services constitutes legal, tax, accounting, or individualized financial advice. You should consult a qualified professional regarding your specific situation before making financial decisions.
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in New York, and you consent to the jurisdiction of those courts, except as otherwise required by applicable law or your services agreement.
We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
